What to Include in a Copyright Infringement Notice

  • 06A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Review of a Complaint

Burton Brokerage may review a sufficiently detailed complaint and may remove, disable access to or investigate material when appropriate. If the material comes from an MLS, IDX provider, listing brokerage, photographer, vendor or another rights holder, Burton Brokerage may need to coordinate with that provider or rights holder.

 

Submitting a copyright complaint does not guarantee that material will be removed. Burton Brokerage may request additional information when needed to identify the work, the material or the complaining party’s authority.

False or Misleading Notices

Copyright notices and counter-notices can have legal consequences. Do not knowingly submit false claims or materially misrepresent that content is infringing. If you are unsure whether material infringes your rights, consider obtaining legal advice before submitting a notice.

Counter-Notice Procedure

If Burton Brokerage removes material in response to a formal DMCA notice and the person who supplied that material believes the removal resulted from mistake or misidentification, Burton Brokerage may provide information about submitting a counter-notice when the Section 512 notice-and-takedown process applies.

 

A counter-notice under Section 512 generally includes:

  • 02Identification of the material removed or disabled and the location where it appeared before removal.
  • 03A statement under penalty of perjury that the submitter has a good-faith belief the material was removed or disabled because of mistake or misidentification.
  • 04The submitter’s name, address and telephone number, together with the jurisdiction and service-of-process statements required by applicable Section 512 procedures.

Listing Photos, MLS Data and Third-Party Content

Listing photographs and MLS/IDX data may be owned or licensed by third parties. Burton Brokerage’s display of listing content does not transfer ownership of that content to Burton Brokerage or website visitors. Do not copy, download, republish or commercially reuse listing photos or MLS/IDX data except as permitted by the applicable owner, license or feed rules.
